Welcome to BhaadaXpress. By accessing or using our mobile application, website, and services, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Definitions

  • "Platform" refers to the BhaadaXpress mobile application and website.
  • "Vendor" refers to a user who places transport orders.
  • "Transporter" refers to a user who fulfils transport orders using their vehicles and drivers.
  • "Driver" refers to a user assigned to operate a vehicle for a transport order.
  • "Order" refers to a request for transport services placed through the Platform.

2. Account Registration

To use the Platform, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must complete KYC verification as required.

3. Use of the Platform

You agree to use the Platform only for lawful purposes related to logistics and freight management. You shall not:

  • Use the Platform for any illegal or unauthorized purpose
  • Provide false or misleading information
  • Interfere with the proper working of the Platform
  • Attempt to gain unauthorized access to other user accounts
  • Upload harmful, offensive, or infringing content

4. Orders and Responsibilities

Vendors are responsible for providing accurate order details including pickup/drop locations, quantities, and required documentation. Transporters are responsible for assigning appropriate vehicles and drivers, and ensuring timely pickup and delivery. Drivers are responsible for safe transport and uploading proof of delivery.

5. Documents

Users are responsible for uploading genuine and accurate documents including but not limited to tax invoices, delivery challans, e-way bills, weight slips, and proof of delivery. Uploading fraudulent or forged documents is strictly prohibited and may result in account termination.

6. GPS Tracking

By using the Platform, you consent to real-time GPS tracking of vehicles assigned to orders. This tracking is used to provide order status updates and ensure transparency between vendors and transporters.

7. Payments

Payment terms between vendors and transporters are managed as per their mutual agreements. BhaadaXpress provides payment status tracking on the Platform for transparency but is not responsible for payment disputes between parties.

8. Limitation of Liability

BhaadaXpress is a technology platform that facilitates connections between vendors and transporters. We are not a transport company and do not take responsibility for the physical transport of goods. We shall not be liable for:

  • Damage, loss, or delay of goods during transport
  • Disputes between vendors, transporters, and drivers
  • Accuracy of documents uploaded by users
  • Service interruptions due to technical issues or force majeure

9. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, provide false information, or engage in activities harmful to the Platform or other users.

10. Intellectual Property

All content, logos, trademarks, and software associated with BhaadaXpress are our intellectual property. You may not copy, reproduce, modify, or distribute any part of the Platform without written permission.

11. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify users of significant changes via the app or email.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.
